Please read these Terms of Service ("Terms") carefully before using the Luma mobile application ("the App") operated by Luma Inc.

1. Acceptance of Terms

By accessing or using the Luma app, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the App.

You agree to:

• Use the App only for lawful purposes and in accordance with these Terms
• Perform facial exercises and rituals at your own pace and comfort level
• Stop immediately if you experience any pain, discomfort, or unusual symptoms
• Not hold Luma liable for any injuries or adverse effects resulting from improper use
• Keep your account credentials secure and confidential

4. Subscriptions & Billing

Luma offers a "Premium" subscription that unlocks full access to programs and rituals.

• Payment: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Pricing: Subscription pricing may vary by region and may change with notice. The price confirmed before purchase is the price you will be charged.
• Cancellation: You can manage or cancel your subscription in your device's Account Settings (Apple App Store or Google Play Store). We cannot cancel subscriptions on your behalf. Cancellations take effect at the end of the current billing period.
• Free Trials: If offered, any unused portion of a free trial will be forfeited when you purchase a subscription.
• Refunds: Refunds are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.

5. User Content & Progress Photos

You retain ownership of all content you create in the App, including progress photos. By default, your Face Gallery photos are stored locally on your device and are not uploaded to our servers. If you enable cloud backup (if available), you grant us permission to store your photos securely on our servers solely for the purpose of providing backup and sync functionality.

Your privacy is paramount. Please review our Privacy Policy to understand how we collect, use, and protect your information.

7. Intellectual Property

The videos, text, graphics, user interface, and structure of the Luma programs are owned by Luma Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, reproduce, distribute, or create derivative works from our content
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or proprietary notices
• Use our content for commercial purposes without written permission

8. Prohibited Conduct

You agree not to:

• Use the App in any way that violates any applicable law or regulation
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the App's functionality or servers
• Attempt to gain unauthorized access to any portion of the App
• Share your account credentials with others

9. Limitation of Liability

To the maximum extent permitted by law:

• Luma is provided "as is" without warranties of any kind, either express or implied
• We do not guarantee that the App will be error-free, uninterrupted, or secure
• In no event shall Luma, nor its directors, employees, partners, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App
• Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months prior to the claim

10. Indemnification

You agree to indemnify and hold harmless Luma and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
